Speeding Ticket on PCH - legal discussion

IMO,

It will be a difficult task to determine the speed of any video tape reviewed unless you had an odometer on display during the recording.

It's not like catching an assault on tape, you either did it or not. Assaults are not measured in how long it takes but if the "act" itself was committed.

They would really be reaching to try and convict someone with out the assistance of a radar, laser or speed-reading device.

Although you need to ask yourself is it admissible? It has to be relevant to the charges; if a judge does not see that is relevant then it will not be admissible in a trial.

they can use the tape if you plan on fighting it...its evidence isnt it?

as far as incriminating others I dont think they can.

well..I dont know about those laws...but your ticket was it from radar? Where was the cop? Where were you pulled over?

I am no "expert" but I fought and won 2 radar speeding tickets..so I have some tricks to win...

Hey, I told the officer that I don't know you guys. We met on myspace and drove together. We were not part of any club. ;)

AI, I got pulled over near the PCH and 10 fwy tunnel. Didn't catch where the cop was but he got me on Lidar (laser radar prehaps). My V1 did warn me but it was too late.

I haven't decided to fight yet but any trick to fight it is welcome. Thanks.

Also, couple co-workers told me that the cop didn't have the authority to grab my tape since it was personal property. By doing just that, I might have a better chance in court. What do you think of that argument?


Actually you could "maybe" explain to the court if you fight the ticket that without your tape you couldn't prepare your case since you couldn't try to locate others you met on "MySpace"......

Call the watch commander and ask for the tape, if that yeilds not results go to the Police Chief and then let them know you need the tape back to present your case in court. You can then take it up with the Mayor's office....

Hey Rich..

if you are truly serious on fighting this...we can chat on Wed. I will help you with some of my experience fighting the ticket. It will take alot of work and research. Put it this way...if you fight it..the way I fight it...there is a 100% chance the cop will show. Because you will be asking for all his crap in a discovery request. More on Wed...I can share my secrets to you!

I've fought tickets with the cop there using RADAR, if you do some reasearch and can raise some questions regarding the proper use of the equipment and the operators effectiveness IN TRAFFIC then all you need to do is raise reasonable doubt.

Sure you can still fight the ticket, I've had one on the books once that was almost a full year later.... Sometimes the cops just say, who cares it was a year later......

It will be in your best interest to protest the ticket.

I can tell you this from experience, if EVERYONE protested their tickets they wouldn't have the time to hear all the cases nor would they have the man power to keep up with court dates etc. I'd say 50% of the time they cop won't show up, what do you have to loose?

not true...the only good thing about fighting a ticket is if you lose the judge will 99% of the time cut some break, either reduce your fine or give you traffic school.

If you lose and the judge says you are guilty...ask for mercy and ask for traffic school...the judge will decide then to give it or not. Usually they will at least lower the fine or remove a point or something.

As it happens in many cases these days, if they don't have the man-power to pull a cop off the streets then do you think a citation really matters all that much?

See how many cops don't show, it will amaze you....

In Los Angeles court they will ask everyone who want's traffic school & will even state that they will not be given a chance if they loose their case in court. Many people elect the Traffic School... soon after they start dismissing all the ticket holders who's officers are a no-show... TONS!!!
